Terms of Service

1. Acceptance

These Terms of Service ("Terms") form a binding agreement between you and ForePlz [Company Legal Name, LLC] ("ForePlz", "we", "us"). By creating an account, accessing or using ForePlz (the "Service") you agree to these Terms, our Privacy Policy, Cookie Policy, Acceptable Use Policy and Virtual Items Terms, which are incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (16 in the European Economic Area and United Kingdom, unless a parent or guardian consents) to use the Service. If you are under the age of majority where you live, your parent or guardian must review and accept these Terms. You represent that you are not barred from using the Service under applicable law.

3. Accounts

You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it up to date. Notify us immediately of unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.

4. The game and real-world locations

ForePlz is an entertainment simulation. Plots, courses and golfers are fictional game content placed over public map and elevation data. Claiming a plot in the game grants no right, title, license or interest in any real-world land, and ForePlz is not affiliated with, endorsed by or sponsored by any real golf course, club, landowner, municipality or governing body. Do not enter, survey or trespass on real property based on the game. Game simulations of golf, turf, climate, costs and economics are approximations and are not professional, engineering, agronomic, financial or legal advice.

5. Virtual currency and items

In-game money, courses, plots and other virtual items are a limited, revocable, non-transferable, non-sublicensable license to use within the Service. They have no monetary value, are not property, cannot be redeemed for cash, and may be modified, rebalanced or removed at any time. Future features such as course sales, marketplaces, simulator play or paid community creation are governed by the Virtual Items Terms and any additional terms presented at that time.

6. Your content

You retain ownership of course designs, names and other content you create ("User Content"). You grant ForePlz a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to host, reproduce, display, modify, distribute and create derivative works of User Content to operate, promote and improve the Service, including displaying it to other users and on golf simulators. You represent you have the rights to your User Content and that it does not infringe any third party's rights.

7. Acceptable use

You agree to follow the Acceptable Use Policy. Prohibited conduct includes cheating, exploiting bugs, automation or bots, reverse engineering, harassment, hateful or illegal content, infringing trademarks (including real course names you do not own), and interfering with the Service.

8. Intellectual property

The Service, software, art, trademarks (including "ForePlz") and all related content are owned by ForePlz or its licensors and protected by law. Except for the limited license to use the Service, no rights are granted to you.

9. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice complying with 17 U.S.C. § 512(c)(3) to our designated agent at legal@foreplz.com. Repeat infringers' accounts will be terminated.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT GAME DATA, SAVES OR VIRTUAL ITEMS WILL BE PRESERVED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOREPLZ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, VIRTUAL ITEMS OR PROGRESS, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent permitted.

12. Indemnification

You agree to defend, indemnify and hold harmless ForePlz and its affiliates from any claims, damages, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms or your violation of any rights of a third party, including any real-world actions you take based on the game.

13. Dispute resolution; arbitration; class-action waiver

PLEASE READ CAREFULLY. Except for small-claims matters and claims for injunctive relief regarding intellectual property, you and ForePlz agree to resolve disputes by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU AND FOREPLZ WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@foreplz.com. This section does not apply where prohibited by law, including for consumers in the EEA/UK, who may bring claims in their local courts.

14. Governing law

These Terms are governed by the laws of the State of [Governing State], USA, without regard to conflict-of-law rules, and the Federal Arbitration Act. Mandatory consumer protections of your country of residence still apply.

15. Termination

You may delete your account at any time from Account → Privacy. We may suspend or terminate access at any time for any reason, including violation of these Terms. Sections that by their nature should survive (including 5, 6, 8, 10–14) survive termination.

16. Changes

We may update these Terms. Material changes will be notified in the Service, and you will be asked to accept the new version. Continued use after the effective date constitutes acceptance.

17. General

These Terms are the entire agreement regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. Contact: legal@foreplz.com, [Company mailing address].
